Gaps in Maryland school reporting of student criminal offenses raise concerns


State school leaders addressed lawmakers on the Legislative Rules Committee about emergency regulations requiring increased communication about student criminal records during a recent hearing. The emergency rules, approved by the Maryland State Board of Education, mandate that superintendents share information about students’ criminal records, specifically reportable offenses, with the corresponding school system within 24 hours of an off-campus arrest.

While discussing the emergency rules, concerns were raised about possible gaps in the system, particularly regarding communication about students in the Juvenile Services Education Program (JSEP) and their criminal history. Lawmakers expressed the need to address these gaps, with State Superintendent Dr. Carey Wright emphasizing the importance of information sharing.

Examples were provided during the hearing, such as a 17-year-old student with a criminal record being arrested at a high school in connection with a homicide investigation, raising questions about prior communication and decision-making processes. The need for statutory changes to address these gaps, particularly regarding JSEP students’ criminal history, was highlighted.

The annual report on reportable offenses in Maryland is due by Dec. 30. Lawmakers are urged to address the communication gaps identified to ensure student safety and informed decision-making by school officials.
