In a recent court filing, Maryland Attorney General Anthony Brown’s office presented grave concerns about the conditions in the Immigration and Customs Enforcement (ICE) hold room at the Fallon Federal Building in downtown Baltimore. This facility, intended for temporary detainment of immigrants, has come under scrutiny for reportedly failing to meet even basic standards that would apply if it were state-run.

The filing supports two Central American immigrant plaintiffs, who allege severe mistreatment during their time in ICE custody. Both women claim they were denied proper access to food, water, and medical care—including medication for their existing ailments—while being held for over 36 hours, significantly exceeding the facility’s intended limit of 12 hours.

Brown’s office argued that these conditions could violate Maryland standards for adult detention centers, which stipulate access to adequate meals, bedding, hygiene, and legal counsel. They emphasized that the lack of basic necessities poses a public health risk and contravenes the state’s public policy for humane treatment.

“The conduct described in the plaintiffs’ complaint is contrary to the public interest,” Brown stated, urging the court to uphold the rights of those in ICE custody. His appeal comes amid rising tensions between federal and local officials regarding immigration enforcement.

Attorneys for the plaintiffs are seeking a preliminary injunction to prevent ICE from operating the hold room under conditions deemed punitive and unconstitutional. Despite the federal agency’s prior claims of an exemption allowing longer stays in the room, Brown’s intervention shines a light on broader issues regarding the treatment of immigrants in detention.

The situation continues to unfold as advocates push for systemic reform and stricter oversight of ICE facilities.
