Judges criticize Trump administration for their legal strategies

This week, judges expressed frustration with the Trump administration in court, accusing it of using bad faith tactics, disingenuous arguments, and making inaccurate claims. In one case, a judge suggested contempt proceedings after the government failed to comply with a restraining order halting deportations. Another judge ordered the return of a deportee mistakenly sent to El Salvador. Despite this, the administration had a win when the Supreme Court allowed the termination of Education Department grants.

In another case, a judge in California temporarily blocked the administration from ending Temporary Protected Status for Venezuelan nationals. The judge found the decision to be unauthorized and motivated by unconstitutional animus. The administration tried to challenge the ruling, but the judge rejected their arguments.

Additionally, the Justice Department attempted to seek a stay in a case involving the Consumer Financial Protection Bureau, but the judge found their claims to be unreliable and inaccurate. Despite this, the 4th U.S. Circuit Court of Appeals granted the government a partial temporary stay.

The week ended with the Supreme Court siding with the administration in allowing the termination of education grants that were seen as violating Trump’s policy on diversity, equity, and inclusion efforts. This decision blocked a previous ruling by a Massachusetts-based judge. Overall, the Trump administration faced pushback from judges in multiple cases throughout the week.
