School board member investigated under Title IX for remarks regarding transgender policies

Recently, a conservative school board member in Frederick County, Maryland, Colt Black, was put under investigation after speaking out against the district’s transgender-affirming policy. Black raised concerns about Board Policy 443, stating that it violates free speech and freedom of association rights under the First Amendment. After his comments, multiple complaints were made against him, leading to a Title IX investigation that alleged he violated the nondiscrimination policy. Legal group Alliance Defending Freedom (ADF) sent a letter on Black’s behalf, accusing the board of unconstitutional retaliation against him for exercising his free speech rights. They are pressuring the board to drop the investigation. Black believes the policy makes schools less safe and infringes on parental and constitutional rights. The policy is up for review in May, and with more Republicans elected to the board, there is a renewed push to reexamine it amid similar scrutiny at the state and federal levels. President Trump has also signed executive orders related to transgender rights in schools.
