Court prohibits relocation of 3 transgender inmates to male correctional facility


A federal judge in Washington, D.C., temporarily blocked prison officials from transferring three transgender women to men’s facilities and cutting off their access to hormone therapy as ordered by President Donald Trump. The judge’s decision came after arguments that the order discriminates against transgender individuals and violates their Constitutional rights. The lawsuit was filed on behalf of the three women who were previously housed in women’s facilities before Trump’s order was signed. Another federal judge in Boston had previously issued a restraining order in a separate challenge to the same executive order, which affected one transgender woman in a woman’s prison.

Trump’s order mandates that males are not detained in women’s prisons and requires revisions to the Bureau of Prisons’ medical care policies regarding transgender inmates. Plaintiffs argued that relocating the women to men’s prisons would jeopardize their safety and well-being. The disruption of their hormone therapy could worsen their gender dysphoria, a medical condition associated with depression and suicidal thoughts. The judge noted that only a small number of transgender women are in female penitentiaries, including the plaintiffs, and the public interest in relocating them immediately was minimal.

The plaintiffs were represented by lawyers from the National Center for Lesbian Rights and GLBTQ Legal Advocates & Defenders, who argued that Trump’s order violates their clients’ rights to equal protection and freedom from cruel and unusual punishment. The Justice Department attorney stated that the plaintiffs had not been denied medical care since the order and that the Bureau of Prisons had not yet decided where to transfer them. The attorneys are seeking to maintain the status quo by keeping the women in women’s prisons for their safety.
