Former President Donald Trump has stated that if re-elected, he would immediately fire special counsel Jack Smith, who has brought federal indictments against Trump. Trump made these comments in an interview with radio host Hugh Hewitt, where he also mentioned that he believes he has immunity at the Supreme Court. Trump referred to Smith as a “crooked person” and stated that he would not be impeached by Democrats if they regain the House majority.
Firing Smith as special counsel could potentially end the federal government’s prosecution against Trump, although Smith is still pursuing a case regarding election interference in Washington, D.C. Trump has delayed court proceedings in this case by claiming presidential immunity, which was ruled on by the Supreme Court in July. Judge Tanya Chutkan recently allowed the release of heavily redacted documents related to the case, which Trump criticized as “election interference.”
Trump has previously criticized both Chutkan and Smith, leading to a gag order being issued against him. He has also warned that Smith and other Justice Department officials would end up in a mental institution if he is re-elected. In response to potential moves by Trump if he regains the presidency, Rep. Adam Schiff has introduced legislation that would prevent a sitting president from dismissing an active criminal prosecution against themselves. However, this measure is unlikely to pass in the Republican-controlled House.
